Welcome to Aqua Luxe Charters (“Company,” “we,” “our,” or “us”). By accessing our website, making a reservation, or participating in any charter operated by the Company, you agree to be bound by these Terms & Conditions.
1. Charter Services
The Company provides private and shared yacht, boat, fishing, snorkeling, sightseeing, and related marine charter services operating within the British Virgin Islands and surrounding waters.
All charters are subject to vessel availability, weather conditions, sea conditions, and operational requirements.
2. Reservations & Payments
A reservation is not confirmed until the required deposit has been received.
• A deposit of 20% is required to secure a booking.
• Full payment must be received no later than 72 hours days before departure unless otherwise agreed in writing.
• Failure to make payment by the due date may result in cancellation of the reservation.
• Prices are quoted in U.S. Dollars unless otherwise stated.
The Company reserves the right to refuse or cancel any booking at its discretion.
3. Cancellation Policy
At Aqua Luxe Charters, we understand that plans can change. To ensure fairness to all guests and allow us to manage our schedule effectively, the following cancellation policy applies to all reservations:
Cancellations made more than seven (7) days prior to the scheduled charter date are eligible for a full refund, including any deposit paid.
Cancellations made within seven (7) days of the scheduled charter date will result in the forfeiture of the deposit. Any payments made in excess of the deposit amount will be refunded.
Cancellations made within seventy-two (72) hours of the scheduled charter departure time are non-refundable, and all payments received will be retained.
No-shows and same-day cancellations are considered non-refundable.
In the event that Aqua Luxe Charters must cancel a charter due to unsafe weather conditions, mechanical issues, or other unforeseen circumstances that prevent the safe operation of the vessel, guests will be offered the option to reschedule their charter or receive a full refund.
4. Passenger Conduct
All passengers agree to:
• Follow all instructions provided by the captain and crew.
• Comply with applicable maritime laws and regulations.
• Behave in a respectful manner toward crew members and other passengers.
• Avoid actions that may endanger themselves, others, or the vessel.
The Company reserves the right to terminate a charter without refund if passenger behavior creates a safety concern.
5. Safety Requirements
Passengers acknowledge that boating activities involve inherent risks, including but not limited to:
• Rough seas
• Slippery surfaces
• Marine wildlife
• Diving and snorkeling hazards
• Sudden weather changes
• Injury, illness, or death
Participation is voluntary and at the passenger’s own risk.
Passengers must immediately disclose any medical conditions, disabilities, allergies, or circumstances that could affect their safety during the charter.
6. Alcohol & Illegal Substances
Alcohol may be consumed responsibly by passengers of legal drinking age.
The possession, use, or distribution of illegal drugs is strictly prohibited.
The captain reserves the right to terminate a charter immediately if illegal substances are discovered on board.
7. Damage to Vessel
Guests are responsible for any damage caused by intentional misconduct, negligence, or failure to follow crew instructions.
The Company reserves the right to recover repair, replacement, cleaning, and associated costs from the responsible party.
8. Liability Limitation
To the maximum extent permitted by law:
• The Company shall not be liable for indirect, incidental, consequential, or special damages.
• The Company’s liability shall be limited to the amount paid for the charter.
• The Company shall not be responsible for loss, theft, or damage to personal property brought aboard.
Passengers assume all risks associated with participation in marine activities.
9. Force Majeure
The Company shall not be liable for cancellations, delays, or interruptions caused by circumstances beyond its reasonable control, including:
• Hurricanes
• Tropical storms
• Severe weather
• Government restrictions
• Port closures
• Mechanical failures
• Acts of God
• Public health emergencies
10. Photography & Media
During charters, photographs and videos may be taken.
Unless otherwise requested in writing, passengers grant the Company permission to use photographs and videos for marketing, advertising, social media, and promotional purposes without compensation.
11. Website Use
All content on this website, including:
• Logos
• Images
• Videos
• Text
• Graphics
• Branding
is the property of the Company and protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or use website content without written permission.
12. Privacy
Personal information collected through this website is handled in accordance with our Privacy Policy.
By using our website, you consent to the collection and use of information as described in that policy.
13. Indemnification
You agree to defend, indemnify, and hold harmless the Company, its owners, captains, crew members, employees, contractors, and affiliates from any claims, liabilities, damages, losses, costs, or expenses arising from:
• Your participation in charter activities
• Your breach of these Terms & Conditions
• Your negligent or unlawful conduct
14. Governing Law
These Terms & Conditions shall be governed by and interpreted under the laws of the British Virgin Islands.
Any dispute arising from these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of the British Virgin Islands.
15. Changes to These Terms
The Company reserves the right to modify these Terms & Conditions at any time without prior notice.
Updated versions will be posted on this website and become effective immediately upon publication.
